These terms and conditions are legally binding between Zellow Home Pty Ltd (www.zellow. com.au) (hereinafter refers to as “Zellow”) and you. Using this website means that you have read, understood and accepts all of the terms and conditions stated herein. If you do not accept to any of these terms, please leave this website now.

We reserve the right to make changes to these terms and conditions at any time without prior notice. We suggest checking these terms and conditions from time to time. Using this website following such changes means that you have read, understood and accept such changes.

PRODUCT CHANGES

We also reserve the right to make changes to the product described in this website and other content herein at any time without prior notice.

PRODUCT DESCRIPTION

While we endeavour to provide an accurate description of the Products, We do not warrant that such description is accurate, current or free from error. Colours displayed on the website may not be the actual colours being delivered unless otherwise specified in your order. We reserve the right to correct such inaccuracies or typographical errors as they are identified. We make no representations about the suitability of this information; it is provided "as is" without warranty of any kind.

PAYMENT AND FEES

  1. Pricing. All product price displayed on this website represents the full price, including GST but does not include postage, delivery charges, customs, etc and such will depend on the destination.
  2. Accuracy. We will make our best efforts to ensure the accuracy of our product pricing, however, we cannot guarantee 100% accuracy thereof. Should there be a pricing error on the product listed on this website, we reserve the right to refuse to accept further orders and to cancel any orders already placed on the incorrect price. We will immediately inform you and will send you a reimbursement process in case an order has been made and charges have been made to your account.
  3. Reservation. We reserve the right to change its prices and fees at any time, and such modifications shall be posted on this website and effective immediately without the need for any further notice
  4. Payment.
    1. Acceptable Payment Method. We only accept payment through PayPal and Credit cards (AMEX, Visa and Mastercard). Payment will not be processed until we have received all relevant information required for processing to be completed. The processing of payment for Orders placed on a weekend or a Public holiday will not begin until the next working day. We also process PayPal payments when you checkout from the product order screen
    2. Credit Cards. We only accept Australian credit cards only. We do not accept international credit cards. We process Credit cards payments when you checkout from the product order screen. Whilst we employ the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, we will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorized manner.

ELIGIBILITY

  1. Age.  Our services is available only to legal entities and persons who are at least eighteen (18) years old and are otherwise capable of forming legally binding contracts under applicable law.
  2. Warranty. By placing an order, you hereby warrant that you are 18 years old or older and is capable of forming legally binding contracts under applicable law.
  3. Damages. Should we suffer any loss or damage as a result of a transaction entered into by a person under the age of 18, we reserve the right to seek compensation for such loss or damage from the parents or guardians of the person who placed the order(s) with us
  4. Location. The information on this website is intended for Australian consumers only and is governed by Australian laws.

INTELLECTUAL PROPERTY

Materials, including source code, pages, documents, graphics, audio and video on the Site are protected by law. The intellectual property rights in the materials are owned by or licensed to us. All rights are reserved. No part of the Site may be reproduced or reused for commercial or any other purposes whatsoever without our prior written permission.

ORDER AND DELIVERY

  1. Information. You agree to provide us with the correct required information and warrant that the provided information is correct and complete during the time of order.
  2. When You Made An Order. You may place an Order by completing the Order form on this website and clicking on the “Check Out” button. We will not accept Orders placed in any other manner. We encourage you to review first the order cart before purchase. You shall be responsible for ensuring the accuracy of the Order.
  3. Compliance.  You agree to comply with any and all the guidelines, notices, operating rules and policies and instructions pertaining to the purchase of Products through this website, as well as any amendments to the aforementioned, issued by Us, from time to time. We reserve the right to revise these guidelines, notices, operating rules and policies and instructions at any time and you are deemed to be aware of and bound by any changes to the foregoing upon their publication on this website.
  4. Customer’s Acknowledgment. You acknowledge and warrant that you have not relied on any term, condition, warranty, undertaking, inducement or representation made by or on our behalf which has not been stated expressly in your purchase order or upon any descriptions or illustrations or specifications contained in any document including any catalogues or publicity material produced by either Us or by the Manufacturer.
  5. Order Acceptance Policy. Your receipt of electronic or other forms of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We also reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.
  6. Delivery. Orders usually shipped from our warehouse within the next 24 to 48 hours during a working day after full payment is received. Delivery of your purchased item may vary per user location. We will use reasonable endeavours to deliver products on or before the date for delivery set out in our order confirmation or, if no date is set out in our order confirmation, within 5-14 working days of the date of our order confirmation.  There are some instances that shipping and delivery make take longer time due to unexpected reason such as hold-ups with 3rd party couriers. We encourage you to visit the "My Account" section on our website to view the delivery status of your product. Please contact us if your item/s are not delivered within 20 days from the date of purchase, any claims of non-delivery outside this time frame will be considered delivered to you.
  7. Undeliverable Packages. In the unlikely event that your parcel is returned to us, our customer service representative will contact you via email.
  8. Inaccurate address. If a delivery was sent to the address supplied but was incorrect. The buyer is responsible to pay the extra delivery costs to resend again.
  9. Unsuccessful Delivery Attempt. If no one is present when the order arrives and it is being delivered by Australia Post, a notification will be left in the mailbox for you to pick up your parcel in your local Post Office. If your item is delivered by Toll IPEC, Fastway, Hunter Express, Allied Express or other 3rd party couriers. A re-delivery cost may occur if the courier company charges us to re-deliver.
  10. Rejected by Receiver. If your item is a gift, please ensure the receiver knows about it to avoid parcel rejection. A re-delivery cost will occur if a parcel has to be resent
  11. Undeliverable Postcodes. Due to the limited access of our carriers, there are certain postcodes that we are unable to deliver to. Please refer to the list below for more details.
  12. Shipping Restrictions Due to courier restrictions, there are some locations we are unable to deliver too. Use our shipping calculator on the product page to see if your location is on our restricted list. Contact us if you have any further queries.

CREDIT CARD CHARGES AND CREDIT CARD FRAUD PENALTIES

  1. You hereby warrant that you are over 18 years of age, or of legal age to enter into contractual agreements in the state in which he is present when he makes this purchase and is the true and authorized owner of the credit card used to make this purchase. Anyone who violates any of these requirements may be liable for civil or criminal prosecution and agrees to pay liquidated damages of an amount the equivalent of AUD$10,000 per fraudulent transaction, plus actual damages, and agrees that all information collected by this website may be used for prosecution and may be turned over to law enforcement agencies or to credit card companies and merchant service providers.
  2. If the true and/or authorized owner of the credit card attempts to commit fraud upon Us, you hereby authorize each and every credit card company or merchant service provider to disclose to us all information that could be construed as proof of credit card fraud.
  3. Anyone who attempts to perpetrate a fraud upon Zellow involving the use of a credit card herewith gives authorization for the Zellow to access all credit information about You from credit reporting agencies and also authorizes Zellow to discover all relevant information from any source about the fraudulent practices and to reveal such information to credit reporting agencies, credit card companies, merchant service providers, and law enforcement agencies.
  4. You agree that if you use trickery to receive more than one refund, or the same causes a fraudulent dispute claim that results in a chargeback against Zellow, that Zellow is authorized to re-charge to your credit card that was used for the original purchase to the extent that will make Zellow whole. You hereby agree, in addition to actual damages, pay to the Zellow liquidated damages of an amount equivalent to AUD$10,000 for every separate fraudulent action You commit.

RETURNS AND WARRANTY POLICY

  1. Change of Mind Returns. We offer a 100% Satisfaction Guarantee on products purchased directly from us. If you are not completely satisfied, you may return the remainder of the product to us for a refund or exchange within 10 days of product receipt. A restocking fee equivalent to 20% of the full price of the goods as well as the return courier fee will be charged to you. The return courier fee is different to our complimentary "free shipping" and is to be paid by the customer to determine whether the item is still eligible for COM (Change Of Mind) return, you do need provide some photos to show that the package is still original and in re-sellable condition. Certain types of products may not be returned under this policy. Please contact our customer service to find out more information.
  2. Warranty. We offer 12 months warranty on all of our products. Some products may have an extended warranty, please refer to our product listing for the warranty period. All our goods come with a warranty that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or a refund for a major failure and for compensation for other foreseeable losses or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Replacement products are subject to the same warranties as the original.
  3. Warranty Exception. We reserve to deny warranty on the following cases:
    1. Full consummation of the product
    2. If the product has become of unacceptable quality due to fair wear and tear, misuse, failure to use in accordance with manufacturer’s instruction, or using it in an unusual way or failure to take reasonable care.
  4. Faulty Product. In the unlikely event that items arrive damaged or faulty, you are required to notify us within 2 working days upon the receipt of the goods. In addition to a detailed description, you are required to provide images (or a short video clip if more appropriate) of the damage in order to proceed with the warranty process. Once assessed and approved by our customer service team, you will be contacted to proceed with the return, refund or replacement process. Please do not attempt to return the item without our approval.
  5. Initiating Warranty and Returns.
    1. To initiate a return, we must first be informed of the warranty and returns and the reason thereof. You must also provide us a copy of your sales invoice or any kind of proof showing that you’ve purchased the items from us.
    2. Shipping fees are non-refundable. You are responsible for any shipping costs involved with the return.
    3. If any returned merchandise is rejected, these will be reshipped.
    4. Deposits, discounted merchandise or merchandise on sale, fees, gift cards, Made-to-Orders and personalised merchandise are considered the final sale and cannot be returned.
    5. We will charge 20% of the product’s full sale price as restocking fee for change of mind returns.
    6. To be eligible for a return, your item must be in the original packaging. Your item needs to have the receipt or proof of purchase.
    7. Once we received your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you of the status of your request after inspecting the item. If your request is approved, we will initiate a refund in the same payment method you use or provide a replacement.
  6. Reservation. We reserve the right to decline refund requests after consummation of the product. Item or product must be in the same condition when you received it.

 

STATUTE OF LIMITATIONS

Regardless of any statute or laws to the contrary, you must file any claim or cause of action arising out or related to the Website within (1) one year after such claim or cause of action arose or be forever barred. This section shall survive termination of this AGREEMENT.

GENERAL

If any provision of this Agreement is adjudged by a court to be void or unenforceable such provision shall no way affect any other provision of this Agreement, the application of the provision in any other circumstances or the validity or enforceability of this Agreement and such provision shall be curtailed and limited only to the extent necessary to bring it within legal requirement.
